Knoxville —
On Aug. 21, an Associate District Court Judge sentenced Peter Allen Branderhorst to an indeterminate prison sentence not to exceed two years for Public Intoxication Enhanced.
Branderhorst was arrested on June 16 in Pella, for being intoxicated in public. When confronted by law enforcement and asked how much if he had to drink that day, he replied, “Not enough, I am still thirsty.”
The defendant provided a breath sample at the police department that registered .178, more than two times the legal limit. The defendant had four prior convictions for public intoxication.
“This offender had previously been provided many opportunities for rehabilitation and treatment, he either declined to participate or failed treatment each and every time,” Marion County Attorney Ed Bull commented. “It is disappointing that the tax payers of our State will have to pay to house him for up to the next two years, but I felt to best achieve the purposes of sentencing: punishment, deterrence, and rehabilitation, that prison was the only place that would keep the public and himself safe.”
